7.3.1 Purchasing – Procurement, Statutory & Other Compliance
Policy
Illinois State University procurement is governed by many State statutes, which include, but are not limited to:
- Illinois Procurement Code, (30 ILCS 500).
- Governmental Joint Purchasing Act (30 ILCS 525)
- Architectural, Engineering, and Land Surveying Qualifications Based Selection Act (30 ILCS 535)
- State Prompt Payment Act (30 ILCS 540)
- Public Construction Bond Act (30 ILCS 550)
- Business Enterprise for Minorities, Females, and Persons with Disabilities Act (30 ILCS 575)
- Prevailing Wage Act (820 ILCS 130)
Illinois State University procurement is also governed by the following:
- Procurement Rules of the Chief Procurement Officer for Public Institutions of Higher Education
- Board of Trustees Governing Document
- Statewide Accounting Management System (SAMS)
Prohibited Purchases and Legal Liabilities
- University funds may not be used for the purchase of any alcoholic beverage except as provided for in University policy.
- New or used University property may not be used as gifts, with the exception of approved University wide award programs for faculty, administrative professionals, and civil service (Example: Civil service awards for years of service.).
- No University contract may be awarded to an employee of the University, or a member of his or her immediate family, or to a business whose owner or primary employees include a University employee or his or her immediate family, unless such purchase or contract is approved by the President of the University.
- No University employee may accept, directly or indirectly, any money, article or other valuable consideration from any person who submits a bid, for the purpose of influencing said employee of the University.
- It is a class 4 Felony for any person to knowingly convey, directly or indirectly, outside of the publicly available official “Invitation to Bid,” any information concerning the specifications or the identity of any particular potential subcontractors, to influence the likelihood of acceptance of such bid. Information to clarify plans or specifications is permitted only where such disclosure of information is made generally available to the public.
