5.1.7 Smoking and Tobacco Use

Preamble

The dangers associated with smoking and smokeless tobacco, and with secondary smoke, are becoming increasingly evident. Those who choose to use tobacco products can do so but must respect the rights of those who choose not to use tobacco products and desire a tobacco-free environment. This policy revision is made with this as background and with a desire to protect the rights of users and non users alike. It is recognized that this policy will be successful when people cooperate and live within the spirit of the policy. While there are procedures available for enforcement, good will and respect for the rights of others are the keystones of the successful implementation of this policy.

The State of Illinois promulgated Public Act 095-0017 which restricts smoking on all state properties. This policy incorporates all requirements of Public Act 095-0017.

Policy

Smoking is prohibited in all facilities at Illinois State University:

  • Inside all buildings/facilities, to include inside sports stadiums, gymnasiums, pavilions, or other similar places where the general public may assemble;
  • Inside all University vehicles;
  • Within a distance of 15 feet from entrances, exits, windows that open, and ventilation intakes that serve any campus building.

Smoking receptacles have been strategically placed throughout campus and those who smoke are requested to use them so that a clean and visually attractive campus is maintained. Signs have been posted to assist in communication of the campus' revised smoking policy.

Where student activities and/or learning takes place, the use of smokeless tobacco is also prohibited. This includes: libraries, classrooms, laboratories (educational, research, and computer), and facilities where student conferences and meetings occur. Included are university vehicles when students are present. Smoking and smokeless tobacco is further prohibited in outdoor areas where seating is provided, such as: athletic contests, concerts, and other types of entertainment and productions.

The promotion of tobacco products through campus organizations and activities is prohibited, as well as the advertising of tobacco products through campus media.

Exceptions to the Policy

Smoking and the use of smokeless tobacco may be permitted in University owned private residences.

Definition of Smoking

The burning of any type of lighted pipe, cigar, cigarette, or any other smoking equipment, whether filled with tobacco or any other type of material.

Definition of Smokeless Tobacco Products

Smokeless tobacco consists of the use of snuff, chewing tobacco, smokeless pouches, or other forms of loose leaf tobacco.

Smoking Related Complaints

Where there is a violation, the person should be informed of the University policy. Should that person continue to smoke, and if the person is a University employee, the aggrieved party should talk to the person's supervisor. Otherwise, complainants can use the applicable grievance or disciplinary procedure. Complaints involving faculty can be brought to the Ethics and Grievance Committee; Administrative/Professional (A/P) staff to the A/P Grievance Committee; Civil Service staff to the Office of Human Resources; non- University persons to the University Police; students to the Student Dispute Resolution Services.
